Texas' anti-SLAPP statute, Tex. Civ. Proc. & Rem. Code Ch. 27, applies to a "legal action." A legal action is broadly defined as a "a lawsuit, cause of action, petition, complaint, cross-claim, or counterclaim or any other judicial pleading or filing that requests legal, declaratory, or equitable relief."  Here, the petition qualifies as a legal action since it seeks equitable relief--requiring the reporter to sit down for a deposition and produce documents.

According to Section 27.003(a), "[i]f a legal action is based on, relates to, or is in response to a party's exercise of [protected rights], that party may file a motion to dismiss the legal action." Because the Rule 202 petition is not "based on or in response to" the shipyards exercise of any of the rights listed in Section 27.003(a), the anti-SLAPP statute does not apply to the pre-suit deposition proceeding.
